• A redefined tripwire for the use of imprisonment that requires more than the test of so serious to one where the offender would have to pose a serious threat to the community (see Roberts and Watson 2017: 552).

• The assessment of culpability to include a greater emphasis on the personal, social and material circumstances of the individual and the responsibilities of the State to address them thorough appropriate community sentences.

• Limitations on the use of previous convictions on determining the seriousness of the current offence and instead, their recognition in relation to the suitability of an offender for a particular disposal and/or the repeat use of community rehabilitation measures.

• The acceptance that all sentences of the court involve punishment (restriction on liberty) which does not need to be supplemented by statutory requirements to include a punitive element in community sentences.

• A more sophisticated understanding of the relationship between what punishment means for individual offenders in terms of restriction on their liberty and capacity to respond to court orders.

• A repeal of the post-release licence and supervision arrangements of the Offender Rehabilitation Act 2014 for short-term prisoners (under 12 months) in order to reduce the recycling of individuals between the prison and the community; in its place, the reintroduction of voluntary aftercare arrangements where probation services have a statutory responsibility to assist for ex-prisoners.
